Introduction to the Terms of Use Agreement

Our online store QARYA welcomes you and informs you that below you will find the terms and conditions governing your use of this store, along with all legal effects arising from your use of the store's services via this electronic platform. The use of this store by any person, whether as a consumer of a service or product of the store or otherwise, constitutes acceptance and agreement by that person, who possesses full legal capacity, to all provisions of this Agreement, and confirms their commitment to its rules and contents. This Agreement applies to all forms of dealings between the consumer and QARYA. This Agreement becomes effective and binding once you accept it and begin registering with the store, in accordance with the legislation applicable in the United Arab Emirates regarding electronic transactions.

Article One - Introduction and Definitions

The above introduction is considered an integral part of this Agreement. Below are the definitions of the key terms used in this Agreement:

(The Store) includes all forms of the store on the internet, whether an electronic application, a website, or a physical shop

(The Consumer) the person who engages in e-commerce seeking to obtain products or services provided by the store through its electronic platform

(The Agreement) refers to the terms and conditions of this Agreement, which govern and regulate the relationship between the parties to this Agreement

Article Two - Legal Capacity of the Consumer

The consumer acknowledges that they possess the legal capacity recognized by law to deal with the store, or that they are at least eighteen years of age

The consumer agrees that in the event of violating this article, they bear full responsibility for the consequences of such violation before others

Article Three - Nature of Obligation

The store's obligation toward consumers is to provide the (service or product)

The store may provide other services, such as after-sales services or other related services, depending on the nature and type of (service or product) requested by the consumer

Article Four - Usage Guidelines

The consumer must use the store's electronic platform in accordance with public morals and the regulations applicable in the United Arab Emirates

When purchasing a service or product from this store, the consumer must not use it in a manner that violates public morals or the regulations applicable in the United Arab Emirates

Article Five - Accounts and Registration Obligations

Upon applying to join membership in this store as a user, you are obligated to disclose specific information and choose a username and a confidential password to use when accessing the store's services. By doing so, you agree to the following:

You are responsible for maintaining the confidentiality of your account information and password, and you agree to immediately notify the store of any unauthorized use of your account information or any other breach of your confidential information

The store shall not, under any circumstances, be liable for any loss you may incur, directly or indirectly, whether moral or material, resulting from the disclosure of your username or password

You commit to using your account or membership with the store yourself, and you are fully responsible for it. If someone else uses it, this is considered evidence that you have authorized them to use the store on your behalf and account

You commit to using the store seriously and honestly

You commit to disclosing true, accurate, current, complete, and lawful information about yourself as required during registration with the store, and you commit to updating your data whenever it changes or whenever necessary

Our store is committed to handling your personal information and contact details with complete confidentiality

If the store determines that you have disclosed information that is untrue, inaccurate, outdated, incomplete, unlawful, or in violation of the terms of this Agreement, the store reserves the right to suspend, freeze, or cancel your membership or account on the platform, without prejudice to the store's other rights and legitimate means of recovering its rights and protecting other consumers

In the event of non-compliance with any of the above, the store's management has the right to suspend or cancel your store, membership, or block your access to the store's services again

Article Six - Electronic Communications and Official Communication Channels

The parties to this Agreement agree that communication shall take place via the email address registered on the platform

The consumer agrees that all agreements, announcements, data, and other communications provided electronically shall stand in place of their written counterparts, and shall constitute standalone evidence meeting legal and regulatory requirements

The consumer agrees to the possibility of being contacted and notified of any provisions relating to this Agreement, or relating to dealings with them, through the store's management sending general messages to all consumers or to specific users of the store

Article Seven - Amendments to the Terms of Use and Fees

If any provision or clause contained in this Agreement is cancelled, or if any provision or clause is no longer effective, this shall not invalidate the remaining provisions, clauses, rules, and terms contained in this Agreement, which shall remain in effect until further notice from the store's management

This Agreement - which may be amended from time to time as necessary - constitutes the working mechanism, understanding, and agreement between the consumer and the store

The store may impose fees on certain consumers depending on the offers, products, or services they request, or any fees or taxes imposed by the state on the nature of the product or service

The store reserves the right to add, increase, decrease, or deduct any fees or expenses under the provisions and terms of this Agreement, on any consumer regardless of the reason for their registration

Article Eight - Payment and Settlement Services

The store, through its partners, provides a payment and settlement system, whether fully online through the payment options available on the store, or through any other payment method the store may provide from time to time

The store is committed to setting the price of the service or product it displays in its store in accordance with the recognized market value

The store is committed to providing invoices and receipts for all amounts and profits generated in its store, and is committed to providing the consumer with a purchase invoice for the service or product

The store is committed to providing the accounting specifications recognized in its electronic store, in application of the provisions of this Agreement

Article Nine - Intellectual Property

The store's intellectual property rights are fully owned by the store, whether owned before or after the establishment of this electronic platform

The consumer respects the store's intellectual property rights, including the store's name itself, and other words, logos, and symbols belonging to or displayed on the store, as every right attached to the store's name is fully owned intellectual property of the store

Article Ten - Store Liability

The store is committed to conducting its commercial business through this electronic platform in a lawful manner and in accordance with the regulations applicable in the United Arab Emirates, and in accordance with the provisions of this Agreement

The store bears no liability for any claims arising from errors or negligence, whether direct, indirect, incidental, caused by the consumer, or caused by a third party such as shipping companies

QARYA, its staff, owners, and representatives are committed to ensuring that the (product or service) is sound, lawful, and authorized in accordance with the laws and regulations of the United Arab Emirates, and is used for lawful purposes

Article Eleven - Restriction of Access or Membership

The store may suspend or cancel a consumer's membership, or restrict their access to the platform's services, at any time and without notice, for any reason

Article Twelve - Applicable Law

This Terms of Use Agreement is governed and drafted in accordance with the laws, regulations, and legislation applicable and in force in the United Arab Emirates, and is fully and entirely subject to the regulations applicable before the authorities in the United Arab Emirates

Article Thirteen - General Provisions

If any provision or clause contained in this Terms of Use Agreement is cancelled, or if any provision or clause is no longer effective, this shall not invalidate the remaining provisions, clauses, and terms contained herein, which shall remain in effect until further notice from the store's management. This Terms of Use Agreement - which may be amended from time to time as necessary - constitutes the working mechanism, understanding, agreement, and contract between the store and the consumer. Both parties to this Agreement further agree to the following:

Arabic is the language applicable in interpreting the provisions of this Agreement, or when translating it into another language

All prices displayed on the store's services or products may be adjusted from time to time

Any promotional or marketing offers made by the store are temporary, and the store reserves the right to modify or discontinue such offers at any time

The parties to this Agreement commit to dealing with one another in a manner that does not violate the applicable rules, regulations, and laws relating to the nature of dealings between the store and the consumer

This Terms of Use Agreement may only be cancelled by a decision issued by the store's management
